The new, simplified CDM Regulations revise and bring together the existing CDM 1994 and the Construction (Health Safety and Welfare) (CHSW) Regulations 1996 into a single regulatory package, and apply from April 2007.

Because the terminology used in the new regulations is different, there is a risk that these regulations might apply to theatre set construction work, as well as the more traditional building site constructions. The regulations refer to construction work on a structure, and these terms are widely defined.

Since structure is defined as including any building, steel structure and any scaffold or other structure designed to provide support or means of access during construction work, there is a view that some sets could be caught by the regulations. Even if they do not apply, everyone involved with construction work on stage will have a duty of care for the health and safety of all who may be affected by their activities.

If the regulations do apply, then, at the very least, the designer of the set will be under special duties of care.

ABTT has published a short introduction to the regulations. The Health and Safety Executive has published an approved code of practice and guidance called “Managing Health and Safety Construction” (HSG 224).
